British Columbia is in the middle of the biggest change to its mortgage rules in 50 years and it’s directly relevant to anyone who lends privately or relies on someone to administer their loans.
Who regulates Mortgage Administration in BC
Mortgage services in BC are overseen by the BC Financial Services Authority (BCFSA). Today that’s under the Mortgage Brokers Act (MBA), in force since 1972.
What’s changing in MSA
The new Mortgage Services Act (MSA) comes into force on October 13, 2026, replacing the outdated MBA. It modernizes the framework with a stronger focus on consumer protection and anti–money laundering oversight (following the Cullen Commission), introduces a new Superintendent of Mortgage Services, and brings higher penalties for non-compliance.
Why it matters for administration specifically
The MSA creates four distinct licence categories: dealing, trading, administering, and mortgage lending. For the first time, administering mortgages is its own defined, licensed category in BC. That’s a meaningful upgrade for lenders: the act of holding and handling your loan payments is being brought under explicit, modern licensing and conduct standards.
One timing nuance worth knowing
Not every piece arrives at once. The dealing, trading, and administering licence levels take effect on October 13, 2026, while the separate mortgage lender licence level is being implemented in a later phase, with timing still to be confirmed by the province. Registrants are also completing mandatory transition education during the lead-up. Until the MSA is in force, the existing MBA rules continue to apply.
What it means for you
The direction of travel is clear more transparency, stronger trust and conduct standards, and explicit recognition of administration as a regulated activity. For a lender, that’s good news: it raises the floor on how your capital and payments must be handled.
